Article One – Introduction and Definitions:

The above preamble is considered an integral part of this agreement. Below you will find the meanings and definitions of the key terms used in this agreement:

1. (Tafaseel Store): This definition includes all forms of the store on the Internet, whether as an electronic application, a website on the Internet, or a physical retail store.

2. (Consumer): A person who engages in e-commerce with the intention of obtaining products or services provided by the store through its electronic platform.

3. (Agreement): Refers to the terms and conditions of this agreement, which govern and regulate the relationship between the parties to this agreement.

Article Two – Legal Capacity of the Consumer:

1. The consumer acknowledges that he/she has the legal capacity, under Sharia and statutory laws, to deal with the store, or that he/she is at least eighteen (18) years old.

2. The consumer agrees that, in case of violating this article, he/she shall bear all consequences of such violation towards any third party.

Article Three – Nature of Obligation:

1. The store’s obligation towards the consumers is to provide the service or product.

2. The store may also provide other services such as after-sales support or other related services, depending on the nature and type of the service or product requested by the consumer.

Article Four – Rules of Use:

1. The consumer is obligated to use the store’s electronic platform in a manner consistent with public morals and the laws in force in the Kingdom of Saudi Arabia.

2. When purchasing a service or product from the store, the consumer agrees not to use that service or product in a way that violates public morals or the applicable laws in Saudi Arabia.

Article Five – Accounts and Registration Obligations:

Upon applying for membership in this store as a user, you agree to disclose certain information and choose a username and a confidential password for use in accessing the store’s services. By doing so, you agree to:

1. Be responsible for maintaining the confidentiality of your account information and password, and agree to notify the store immediately of any unauthorized use of your account or any other breach of your confidential information.

2. The store shall not, under any circumstances, be liable for any direct or indirect, moral or material loss resulting from the disclosure of your username or password.

3. You agree to use your account or membership personally, and you are fully responsible for it. If anyone else uses it, it shall be considered as your authorization for them to use the store on your behalf and at your own responsibility.

4. You agree to use the store seriously and honestly.

5. You agree to disclose true, accurate, updated, complete, and legal information about yourself as required during registration and to update your data whenever necessary.

6. The store commits to handling your personal and contact information with complete confidentiality.

7. If it becomes evident that you have disclosed false, inaccurate, outdated, incomplete, or illegal information, or in violation of this agreement, the store has the right to suspend, freeze, or cancel your membership or account without prejudice to its other legal rights and means to recover its rights and protect other consumers.

8. In the event of non-compliance with any of the above, the store management reserves the right to suspend or cancel your membership or prevent your access to the store’s services again.

Article Six – Electronic Communications and Official Means of Contact:

1. The parties to this agreement agree that communication shall be carried out via the registered email on the platform.

2. The consumer agrees that all agreements, announcements, statements, and other communications provided electronically shall have the same legal effect as written documents and shall serve as valid proof to meet legal and regulatory requirements.

3. The consumer agrees that the store management may contact or notify him/her of any matters related to this agreement or dealings through general messages sent to all or specific consumers of the store.

Article Seven – Amendments to the Terms of Use and Fees:

1. If any article or clause of this agreement is canceled or becomes invalid, such an event shall not affect the validity of the remaining articles, clauses, and provisions, which shall remain in effect until further notice from the store management.

2. This agreement — which may be amended from time to time as required — constitutes the framework of operation, understanding, and agreement between the consumer and the store.

3. The store may impose fees on certain consumers depending on the offers, products, or services they request, or as required by governmental taxes or regulations.

4. The store reserves the right to add, increase, reduce, or deduct any fees or expenses according to the provisions and terms of this agreement, for any consumer regardless of the reason for registration.

Article Eight – Payment and Settlement Services for Stores:

1. The store, through its partners, provides payment and settlement services which may be conducted online via the available payment options on the store or through any other payment method the store provides from time to time.

2. The store is committed to setting the price of its services or products according to the commonly accepted market value.

3. The store is obligated to provide invoices, receipts, and payment confirmations for all amounts or profits generated in its store, and must provide the consumer with an invoice for any purchase made.

4. The store is committed to maintaining proper accounting standards in its electronic store in accordance with the terms of this agreement and the relevant legal, economic, and regulatory interests.

Article Nine – Intellectual Property:

1. The intellectual property rights of the store are fully owned by the store, whether acquired before or after the establishment of this electronic platform.

2. The consumer must respect the intellectual property rights of the store, including its name, logos, symbols, and other identifiers displayed on the store. All such rights belong fully to the store.

Article Ten – Store Liability:

1. The store is committed to conducting its business through this electronic platform lawfully and in accordance with the laws of the Kingdom of Saudi Arabia and the terms of this agreement.

2. The store shall not be held liable for any claims arising from errors or negligence, whether directly, indirectly, incidentally, by the consumer, or by any third party such as shipping companies.

3. The store, its owners, and representatives commit to ensuring that the product or service is legitimate, authorized, and compliant with the laws and regulations of the Kingdom of Saudi Arabia, and used for lawful purposes.

Article Eleven – Restriction of Access or Membership:

The store may suspend or cancel the consumer’s membership or restrict access to the platform’s services at any time, without prior notice and for any reason.

Article Twelve – Governing Law:

This Terms of Use Agreement is governed and interpreted according to the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia, and is fully subject to the jurisdiction of the competent authorities therein.

Article Thirteen – General Provisions:

If any article or clause of this agreement is canceled or becomes invalid, such event shall not affect the validity of the remaining articles, which shall remain in effect until further notice from the store management.

This Terms of Use Agreement — which may be amended from time to time as necessary — constitutes the full understanding, agreement, and contract between the store and the consumer. Both parties agree to the following:

1. The Arabic language shall be the language of reference in interpreting the provisions of this agreement, or when translated into another language.

2. All prices displayed for the store’s products or services may change from time to time.

3. Promotional or marketing offers provided by the store are temporary, and the store reserves the right to modify or discontinue them at any time.

4. Both parties agree to deal in a manner consistent with Sharia rules, applicable laws, and regulations governing the relationship between the store and the consumer.

5. This Terms of Use Agreement may only be canceled by a decision issued by the store management.
